These Terms & Conditions (“Terms”) govern your use of the Merry Go Round Toys website and services. By browsing or placing an order, you agree to these Terms.

Using this website

  • You must be 18+ (or have a parent/guardian’s consent) to place orders or submit forms.

  • Do not misuse the site (e.g., attempt to interfere with security or payments).

 

Pre-loved items: condition & accuracy

  • We sell pre-loved toys. Each item is unique and may show signs of previous use.

  • Listings include honest photos and a condition label (see our Condition & Safety Guide).

  • We do not sell soft toys at this time.

  • While we aim for accuracy, minor colour variations or small cosmetic differences can occur. If an item arrives not as described or faulty, see Returns & Refunds.

 

Pricing, taxes & availability

  • Prices are in AUD and inclusive of applicable taxes (unless stated).

  • We may change prices or run promotions at any time.

  • If an item is out of stock or mispriced at checkout, we’ll contact you with options (refund, substitute, or back-order if applicable).

 

Ordering & payment

  • Your order is accepted when we email a confirmation.

  • We accept the payment methods shown at checkout; payment is processed at time of order.

  • Orders may be cancelled or refused if fraud is suspected or an error occurs; any payments received will be refunded.

 

Shipping, pickup & risk

  • Shipping & Pickup details (options, timeframes, rates) are on our Shipping page.

  • Risk in the goods passes to you on delivery/pickup. Title passes when payment is received in full.

  • Local pickup (Victoria Point, QLD 4165) and market pickup are by prior arrangement; we’ll confirm location/time via email.

 

Sand Art Parties & Kits

  • Party enquiries are subject to availability and a confirmed booking.

  • We’ll provide details on setup, hosting and pack-down; a travel fee may apply outside our usual service area.

  • Sand Art kits are for supervised use; follow age guidance and safety instructions provided.

 

Returns, refunds & Australian Consumer Law

  • Your rights under the Australian Consumer Law (ACL) apply in addition to these Terms.

  • If a product is not as described, faulty on arrival or damaged in transit, we will repair, replace (if possible), or refund.

  • Change of mind: As pre-loved, one-of-a-kind items, we don’t generally accept change-of-mind returns (unless stated otherwise on the Returns page).

 

Donations & consignments

  • Donations: We accept complete, working toys only and are unable to accept soft toys at this time. Suitable donations may be sold to fund our work or direct proceeds to partners if you request. Safe items not suited to sale may be donated through partners.

  • Consignment: Consignments are covered by the Consign with Us page and any consignment confirmation we send you. Unless agreed otherwise, the standard share is 60% to Merry Go Round Toys / 40% to the consignor after an item sells (covering preparation, safety checks, listing fees, storage and market costs). We may discount items to achieve sale; we aim for fair pricing and reasonable sell-through.

 

Safety & age guidance

  • Always follow manufacturer age guidance and supervise young children, especially with small parts or battery items.

  • We visually inspect and function-test items, but normal risks of play apply.

  • We do not sell mains-powered electrical items.

 

Promotions, gift cards & store credit

  • Promotion terms (eligibility, dates, limits) will be stated with each offer.

  • Gift cards/store credit (if offered) are valid for the period stated, cannot be redeemed for cash, and are non-transferable unless required by law.

 

Intellectual property

  • Content on this site (text, images, logos) is owned by or licensed to us and protected by law. You may not use it without permission, except for personal, non-commercial use.

 

Privacy

  • We handle personal information according to our Privacy Policy (Australian Privacy Principles).

  • By using the site or submitting forms, you consent to that policy.

 

Liability

  • Nothing in these Terms limits your rights under the ACL.

  • To the extent permitted by law, we exclude liability for indirect or consequential loss.

  • For services and goods not ordinarily acquired for personal, domestic or household use, our liability is limited (at our option) to re-supplying the services/goods or paying the cost of doing so.

 

Events outside our control

  • We’re not responsible for delays or failures caused by events beyond our reasonable control (e.g., carrier delays, extreme weather, system outages).

 

Changes to these Terms

  • We may update these Terms at any time. The latest version will be posted on this page with the Last updated date.

 

Governing law

  • These Terms are governed by the laws of Queensland, Australia. Disputes are subject to the non-exclusive jurisdiction of the courts of Queensland.
